Terms for using OmniQ Growth
These Terms of Service govern your access to and use of the OmniQ Growth website, connected services, workflows and related functionality.
By accessing or using OmniQ Growth, you agree to these Terms. If you use OmniQ Growth on behalf of a business or other organisation, you confirm that you have authority to accept these Terms on its behalf.

Acceptance of These Terms
By accessing the OmniQ Growth website, authorizing a platform connection, requesting a service, or otherwise using OmniQ Growth, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you should not use OmniQ Growth or authorize access to any connected advertising platform.
Where a separate proposal, statement of work, service agreement or other written agreement applies to services provided to you, that agreement will also govern those services. If there is a direct conflict, the separately agreed written terms will take precedence for the relevant service.

About OmniQ Growth
OmniQ Growth provides paid media strategy, analysis, reporting and workflow capabilities designed to support more structured advertising decisions and campaign management.
Depending on the service or functionality being used, OmniQ Growth may assist with activities including:
- Campaign performance analysis.
- Strategic planning and recommendations.
- Advertising account and campaign reporting.
- Identification of optimisation signals and opportunities.
- Structured paid media workflows.
- Authorized connections to supported advertising platforms.
- Execution of workflows or actions specifically configured, requested or approved by the user.
Features and functionality may change as OmniQ Growth develops.

Eligibility and Authority
You may use OmniQ Growth only if you are legally able to enter into an agreement and are permitted to use the relevant advertising platforms and accounts.
If you access OmniQ Growth on behalf of an organisation, client or other third party, you represent that you have the necessary authority and permissions to:
- Use the relevant services.
- Connect the relevant advertising accounts or data sources.
- Provide any information submitted to OmniQ Growth.
- Request or approve actions performed through connected platforms.
You are responsible for ensuring that your use of OmniQ Growth complies with your own contractual, organisational and legal obligations.

Connected Advertising Platforms
OmniQ Growth may connect to supported advertising platforms through APIs, OAuth authorization or other approved integration methods.
Access occurs only after the required permissions have been granted by an authorized user.
The information available through a connection may depend on the platform, permissions granted and functionality requested. This may include account information, campaign structures, advertising performance data, targeting information, conversion information and related campaign data.
Where OmniQ Growth supports workflow execution or changes within a connected advertising account, those actions will be limited by:
- The permissions granted to the connection.
- The functionality supported by the platform.
- The configuration of the relevant workflow.
- Instructions or approvals associated with the requested service.
Authorized access only
You may connect only accounts, advertising data and other resources that you are authorized to access.
You remain responsible for managing permissions within your advertising platforms and may revoke connected access through the relevant platform where supported.

User Responsibilities
When using OmniQ Growth, you are responsible for:
- Providing information that is reasonably accurate and current.
- Ensuring that you have authority to provide any data or account access supplied to OmniQ Growth.
- Reviewing recommendations before implementing material advertising or business decisions where appropriate.
- Reviewing actions or outputs that require your approval.
- Maintaining appropriate security over your own advertising accounts, devices and credentials.
- Complying with the policies and terms of any connected third-party platforms.
You should not rely solely on automated outputs for decisions that require professional, legal, financial or regulatory judgment.

Acceptable Use
You must not use OmniQ Growth to:
- Access an account or information without authorization.
- Violate applicable laws, regulations or third-party rights.
- Circumvent advertising-platform restrictions or security measures.
- Introduce malware, harmful code or other malicious content.
- Attempt to interfere with the security or operation of OmniQ Growth.
- Misrepresent your identity, authority or relationship with another person or organisation.
- Use the service to conduct fraudulent, deceptive or abusive advertising activity.
- Attempt to exceed or circumvent API, usage or access limitations imposed by a connected platform.
We may restrict access where use creates security, legal, operational or platform-compliance risk.

Services, Fees and Separate Agreements
Some OmniQ Growth services may be provided under a separate proposal, statement of work, order, subscription arrangement or service agreement.
Any applicable:
- Fees,
- payment terms,
- deliverables,
- campaign budgets,
- timelines,
- service levels, or
- additional commercial terms
will be agreed separately where relevant.
Nothing on the public OmniQ Growth website constitutes a guarantee that a particular service, feature or pricing arrangement will be available.

Intellectual Property
Unless otherwise stated, the OmniQ Growth website, brand, systems, workflows, original content, documentation, designs and related materials are owned by or licensed to OmniQ Growth.
You may not copy, reproduce, distribute, sell, reverse engineer or commercially exploit OmniQ Growth materials except where expressly permitted.
You retain ownership of information and materials that you provide to OmniQ Growth, subject to the permissions necessary for OmniQ Growth to provide the requested services.
Third-party trademarks, platforms, software and materials remain the property of their respective owners.

Third-Party Services
OmniQ Growth may rely on or integrate with third-party services, including advertising platforms, cloud services, analytics systems and workflow technologies.
Those services are operated independently and may be subject to their own:
- Terms of service.
- Privacy policies.
- Usage limitations.
- Availability.
- API rules.
- Account requirements.
Your use of third-party services remains subject to the terms that apply between you and the relevant provider.
OmniQ Growth does not control and is not responsible for changes, interruptions, restrictions or decisions made by third-party platforms.
Google's current Google Ads API terms likewise state that use of the API and advertising-account management remain subject to Google's applicable terms and policies.

Privacy and Data
Our handling of personal information, authorized advertising-platform data and other information is described in the OmniQ Growth Privacy Policy.
The Privacy Policy explains, among other things:
- What information may be collected or accessed.
- How authorized advertising data may be used.
- How information may be stored or retained.
- Circumstances in which information may be shared.
- How users can manage platform access or make data requests.
You should review the Privacy Policy before authorizing a platform connection.
Use of Google user data through Google APIs is also subject to Google's applicable API and user-data requirements. Google's verification guidance requires applications to accurately disclose how Google user data is accessed, used, stored and shared.

Service Availability and Changes
OmniQ Growth may introduce, modify, suspend or discontinue features from time to time as the service develops.
We do not guarantee that:
- Every feature will always be available.
- A connected third-party platform will remain compatible.
- API access will remain unchanged.
- Advertising-platform data will always be complete, current or error-free.
- A specific workflow or integration will remain available indefinitely.
Where reasonably practical, material changes affecting active services will be communicated through an appropriate channel.

Disclaimers and Limitation of Liability
OmniQ Growth is intended to support paid media analysis, planning, reporting and execution workflows. Advertising performance depends on many factors outside the control of OmniQ Growth.
We do not guarantee:
- Specific advertising results.
- Leads, sales, revenue or return on advertising spend.
- Continuous or error-free availability.
- That every recommendation will produce a particular outcome.
- The accuracy or availability of information supplied by third-party platforms.
To the maximum extent permitted by applicable law, OmniQ Growth will not be liable for indirect, incidental, consequential, special or similar losses arising from the use of the website or services, including losses resulting from third-party platform outages, advertising decisions or unauthorized use of an account.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Suspension and Termination
You may stop using OmniQ Growth at any time.
Where supported by a connected platform, you may also revoke authorization through that platform's account or connection settings.
OmniQ Growth may suspend or restrict access where reasonably necessary because of:
- Security concerns.
- Suspected unauthorized access.
- Violation of these Terms.
- Applicable legal requirements.
- Third-party platform requirements.
- Non-payment under a separate commercial agreement.
- Activity that may create material risk to OmniQ Growth or other users.
Termination does not affect rights or obligations that arose before termination.

Changes to These Terms
These Terms may be updated from time to time to reflect changes to:
- OmniQ Growth services.
- Platform integrations.
- Technology.
- Legal or regulatory requirements.
- Business practices.
The latest version will be published on this page with an updated effective date.
Your continued use of OmniQ Growth after updated Terms take effect constitutes acceptance of the revised Terms where permitted by applicable law.

Applicable Law
These Terms are subject to applicable laws and regulations.
Nothing in these Terms is intended to limit rights or protections that cannot lawfully be excluded under applicable law.
Where a separate commercial agreement between you and OmniQ Growth specifies a governing law, jurisdiction or dispute-resolution process, that agreement will govern those matters for the services covered by it.
